Houston has no zoning code, so fence rules run through the building code rather than a zoning ordinance. Fences of any material up to 8 feet above grade do not require a permit; above 8 feet a permit is required regardless of material. Fences built completely or partially of masonry or concrete require a permit at any height. Deed restrictions recorded on many Houston subdivisions independently impose stricter height and material limits and are enforced separately from the city permit process.

In Houston and most of Harris County there is no zoning, so a wood, chain-link, or wrought-iron fence up to 8 feet generally needs no building permit, the most permissive rule among big US cities. A permit IS required for masonry or concrete fences of any height, fences over 8 feet, and any fence in an A or V floodplain zone. Front-yard fences need Houston Planning Department approval and are kept low (about 3 to 3.5 feet).
