Regardless of the building-permit exemption, every residential fence needs either a Zoning Certificate of Compliance or a Certificate of Appropriateness, depending on location; a fence greater than 6 feet needs a Zoning Variance and a full Building Permit. A Building Permit is always required for any fence on a commercial property, including residential properties exceeding three dwelling units, and for any fence where the gate swings into the public right-of-way. Zoning Code Section 1421-33 caps front, corner-side, or corner-rear yard fences at 4 feet with maximum 50 percent opacity in residential districts; interior side or rear yard fences may reach 6 feet fully opaque.
