Olathe exempts fences not over 7 feet in height from a building permit; pool enclosures are an exception and always need a permit regardless of fence height. Zoning under UDO Section 18.50.050 caps fences, walls, or hedges at 6 feet in residential districts; in front or corner side yards beyond the front of the house, fences are limited to 4 feet, must be at least 50 percent open, and cannot be chain-link or other metal/wire fencing. Retaining walls are permitted where reasonably necessary due to topography, set back at least 2 feet from any street right-of-way, and any retaining wall over 3 feet must have fencing. Fences, walls, or hedges are not allowed in the street-right-of-way setback area, and along arterials they are allowed only when approved as part of a master fence/screening plan.
