Miami-Dade County and every incorporated municipality within it, including the City of Miami, are reported to require a permit for all residential fence installations; the City of Miami has its own Building Department separate from the county's. Front-yard fences are generally capped around 3.5 to 4 feet, with side and rear yard fences up to 6 feet, and stricter limits (around 2.5 feet) near intersections and driveways for visibility. Because Miami sits within the High-Velocity Hurricane Zone, fences must meet Florida Building Code wind-resistance requirements. Fences may generally be placed on the property line, except most chain-link fences, which must sit behind the front building line. Pool barrier fences must meet Florida's Residential Swimming Pool Safety Act (Florida Statute 515) minimum 4-foot height.

Miami-Dade has the strictest fence permitting in Florida because it sits in the High-Velocity Hurricane Zone (HVHZ).
