New York City draws a line most jurisdictions do not. Under 1 RCNY 101-14 Table 1, a packaged air-conditioning unit not exceeding 5 tons rated capacity, installed in an existing building including in an existing window or a sleeve under a window, is exempt from a DOB permit as long as it is not part of an alteration that otherwise requires one. The threshold differs by building: 5 tons for one- and two-family dwellings under Table 1, but only 3 tons for buildings generally under Table 2, which also exempts a voluntary air-conditioning or ventilating system serving a single floor provided it does not use lot line openings, sits outside public hallways and stairways, does not reduce required ventilation and does not penetrate any fire division, roof, floor or wall. Split systems require a permit regardless of size, so in practice almost every ducted system and every mini-split is a filed job. Work is filed with DOB, and any alteration to a one- to four-family dwelling also requires a Hom Plans are reviewed under the NYC Department of Buildings (NYC Construction Codes) code (IRC NYC Construction Cod); apply through New York City Department of Buildings before work begins.
