Toledo does not require a building permit for a fence under 6 feet tall, but a Certificate of Zoning Compliance ($50) is required for all fences regardless of height, per Municipal Code Section 1305.01. A fence over 6 feet is regulated as a structure and needs a full building permit and plan review in addition to the Certificate of Zoning Compliance, and becomes subject to setback requirements (fences under 6 feet have no setback and may sit on the property line). Fencing repairs can be made without a permit or certificate if the repaired area is 100 square feet or less and matches the existing material. Materials not specifically manufactured for fencing (pallets, doors, tires, corrugated metal, tree trunks) cannot be used, and the finished side must face the adjacent property, street, or place.
