Under Municipal Code Section 142.0310, City of San Diego residential fences up to 6 feet in the side and rear yard, and up to 3 feet in the required front or street-side yard, do not need a construction permit. An open fence, defined as at least 35 percent of its vertical surface open to light, may step up in height as it moves back from the front or street-side property line, reaching a maximum of 9 feet at the interior setback line if everything above 6 feet is open rather than solid. Fences within a visibility area near intersections are capped at 3 feet regardless of yard location. A fence built on top of a retaining wall is measured from the higher grade, so the wall height counts toward the fence height limit.
