Berkeley uses a two-tier fence permit system: fences under 7 feet do not require a building permit, but fences over 6 feet need a zoning permit, so a fence between 6 and 7 feet needs a zoning permit even though it is exempt from a building permit. Table 23.304-8 of the Municipal Code lists permit requirements for fences by zoning district. Barbed wire, razor wire, sharp or jagged glass, or similar sharp materials are prohibited on fences in residential districts, and prohibited materials on an existing nonconforming fence may not be expanded or repaired. In the Mixed Use Residential (MU-R) district, a fence over 6 feet along a shared residential lot line must be set back at least 8 feet from any main residential building on the abutting lot, or 4 feet from the property line if that building sits less than 4 feet from the line, unless both lots share the same owner.
